Notice of appearance before police officer., in all cases where the arrest of a person is not required under the provisions of sub-section (1) of section 41, issue a notice directing the person against whom a reasonable complaint has been made, or credible information has been received
Section 41A grants a police officer the authority to arrest an individual without a warrant if the officer possesses reasonable suspicion or a reasonable complaint regarding that individual for a cognizable offense – an offense for which an individual can be arrested without a warrant.
The person who has received the notice u/s 41A should immediately go for an arrest stay in the high court or take anticipatory bail and then visit the police station and tell his side of the story to the police.
